Terms of Service

1. Who We Are

TRKD is a fitness tracking application developed and operated by Not My First Codeo Limited, a company registered in England and Wales ("we", "us", "our"). By creating an account or using TRKD in any way, you agree to these terms.

2. Beta Software

TRKD is currently in beta. This means the app is still in active development and is provided for testing and feedback purposes. You should be aware that:

  • Features may change, be removed, or behave unexpectedly.
  • We cannot guarantee the accuracy or completeness of any data displayed in the app, including personal records, streaks, and statistics.
  • While we take reasonable precautions, data loss is possible during the beta period. We recommend not relying on TRKD as your sole record of training data.
  • Access to the beta may be modified or withdrawn at any time.

3. Your Account

To use TRKD you must be at least 13 years old. By creating an account you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the security of your account. Do not share your credentials with others. If you believe your account has been compromised, contact us at hello@trkd.app immediately.

4. Acceptable Use

You agree to use TRKD for personal, lawful purposes only. You must not:

  • Attempt to reverse-engineer, decompile, or extract the source code of the app or API.
  • Use the service to store or transmit unlawful, harmful, or offensive content.
  • Attempt to gain unauthorised access to other users' data or any part of our infrastructure.
  • Use automated tools to scrape, crawl, or stress-test the service without our written permission.
  • Redistribute, sublicense, or resell access to the service.

We reserve the right to suspend or terminate accounts that breach these rules.

5. Your Data

Your workout logs, body metrics, and other content you create in TRKD belong to you. You grant us a limited licence to store and process that data in order to provide the service. We do not claim ownership of your data, and you can request its deletion at any time. See our Privacy Policy for full details.

6. Intellectual Property

The TRKD name, logo, app design, and underlying software are owned by Not My First Codeo Limited. Nothing in these terms grants you any right to use them outside of normal use of the service.

7. Subscriptions

TRKD offers free and paid subscription tiers. Paid features will be clearly labelled in the app. Subscription pricing, billing terms, and cancellation policies will be detailed at the point of purchase when paid plans become available. During the beta period, no payment is required to access the app.

8. Disclaimers

TRKD is a fitness tracking tool, not a medical device. Nothing in the app constitutes medical advice, diagnosis, or treatment. Always consult a qualified professional before starting a new training programme or making changes to your health routine.

The service is provided "as is" without warranties of any kind. To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and uninterrupted availability.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Not My First Codeo Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use TRKD, including loss of data. Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months prior to the claim (or £50 if no payment was made).

Nothing in these terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

10. Termination

You can delete your account at any time from within the app. We may suspend or terminate your access if you breach these terms, with or without notice depending on the severity of the breach. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. When we do, we will update the date at the top of this page. If changes are material, we will notify you by email or via the app. Continued use of TRKD after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
